Wonderkind Terms of Service
1. About These Terms
Wonderkind is a Montessori school management platform operated by White Wolf Studio ZA (Pty) Ltd ("Wonderkind", "we", "us", "our").
These Terms of Service ("Terms") govern your individual use of the Wonderkind platform as an authorised user — typically a teacher, school administrator, parent, or guardian.
Important: Your school has signed a separate Service Agreement with Wonderkind that governs the commercial relationship between Wonderkind and the school. These Terms apply in addition to that Service Agreement and govern your individual access to the platform.
By accessing or using Wonderkind, you confirm that you have read, understood, and agree to be bound by these Terms along with our Privacy Policy.
If you do not agree to these Terms, do not use Wonderkind.
2. Eligibility
To use Wonderkind, you must:
- Be at least 18 years old, or have permission and supervision from a competent person (parent, guardian, or school administrator)
- Be authorised by your school to access the platform in your stated role (teacher, parent, etc.)
- Have the legal capacity to agree to these Terms
- Not be barred from using the service under any applicable law
3. The Service
3.1 What Wonderkind does
Wonderkind provides a Montessori-focused school management platform with features including:
- Observation capture and learning journey tracking
- Term reports and reporting tools
- Attendance tracking
- Real-time messaging between staff and families
- Administrative tools for school operations
- Multi-campus support (where applicable)
The features available to you depend on your role within the school (teacher, admin, parent) and the school's configuration of the platform.
3.2 What Wonderkind is not
Wonderkind is not:
- A replacement for direct in-person communication with the school
- A guarantee of educational outcomes
- A regulated education provider — Wonderkind provides software, not education
- A legal record of attendance, enrolment, or academic performance (your school's official records take precedence)
4. Your Account
4.1 Account creation
Your account is created either by your school administrator (for staff) or by linking to your child's enrolment (for parents and guardians). You must:
- Provide accurate, current, and complete information
- Keep your account credentials confidential
- Take responsibility for all activity under your account
- Notify the school administrator and Wonderkind immediately of any unauthorised access
4.2 Role-based access
Your access is determined by your role:
- Teachers and admin staff — access scoped to their classes and authorised functions
- Parents and guardians — access scoped to their children's records only
- School administrators — full access within their school
You agree to use the platform only within the scope of your authorised role.
4.3 Account suspension or termination
Your school administrator can revoke your access at any time. Wonderkind may suspend or terminate your access if:
- You breach these Terms
- Your school instructs us to do so
- Your conduct poses a risk to other users or the platform
- We are required to do so by law
5. Acceptable Use
5.1 What you can do
Use Wonderkind to support your role within the school community — teaching, parenting, administering, or communicating in line with your school's policies.
5.2 What you must not do
You agree not to:
- Share your account credentials with anyone, including colleagues or family members
- Access information about students, staff, or families outside your authorised role
- Upload, share, or store content that is unlawful, harmful, threatening, abusive, defamatory, or obscene
- Use Wonderkind to harass, bully, or harm any person, especially children
- Take, share, or distribute photos or media of children without proper consent in line with the school's policies
- Use Wonderkind for any commercial purpose unrelated to the school's operations
- Attempt to gain unauthorised access to other accounts or our infrastructure
- Reverse-engineer, decompile, or attempt to extract source code from the platform
- Scrape, harvest, or systematically extract data from the platform
- Upload malicious code, viruses, or harmful software
- Impersonate any person, child, or institution
- Use Wonderkind in a way that interferes with other users or the platform's operation
5.3 Special obligations regarding children's information
Because Wonderkind processes the personal information of children, you have heightened responsibilities:
- Treat all information about children as confidential
- Only access information about children when necessary for your authorised role
- Do not share children's information, photos, or records outside the school context without proper consent
- Report any concerns about misuse, safeguarding issues, or child protection matters to your school administrator immediately, and to the appropriate authorities where required by law
6. Content and Data
6.1 Content you upload
When you upload content to Wonderkind (observations, photos, messages, reports, etc.):
- You confirm you have the right to upload it
- You confirm you have appropriate consent from any person depicted (especially children, via their parents or guardians)
- You grant Wonderkind a limited licence to host, process, and display this content as needed to provide the service
- The school is the Responsible Party under POPIA for this content
6.2 Data ownership
The data within the platform belongs to your school, not to you individually. If you leave the school, your access ends, but the records you created remain with the school.
6.3 Personal information
Our processing of personal information is described in our Privacy Policy. The platform processes personal information of children, families, and staff under the school's instructions and your authorised role.
7. Communications and Messaging
7.1 Use of messaging features
If you use Wonderkind's messaging features:
- Communicate respectfully and professionally
- Do not send unsolicited promotional content
- Do not share confidential or sensitive information beyond what is necessary
- Be aware that messages may be retained as part of the school's records
7.2 Notifications
You may receive in-app, email, or push notifications related to platform activity. You can manage notification preferences in your account settings.
7.3 Service announcements
Wonderkind may send you essential service announcements (e.g., maintenance, security updates) that you cannot opt out of while you have an active account.
8. Intellectual Property
8.1 Our IP
Wonderkind — including its software, design, branding, content, and underlying technology — is the exclusive property of White Wolf Studio ZA (Pty) Ltd. We grant you a limited, non-exclusive, non-transferable licence to use Wonderkind for your authorised role during your access period.
You may not:
- Copy, modify, or create derivative works of Wonderkind
- Use our branding, logos, or trademarks without written permission
- Suggest endorsement or partnership with White Wolf Studio that we have not granted
8.2 Your content
You retain ownership of original content you create (e.g., your own written observations or notes). Your school may retain rights to content created in the course of school duties — refer to your employment contract or school policies for clarity.
8.3 Feedback
If you provide us with feedback, suggestions, or ideas, we may use them without restriction or compensation.
9. Service Availability
9.1 Reasonable effort
We aim to keep Wonderkind available and reliable but do not guarantee uninterrupted access. Scheduled maintenance, third-party service issues, and events outside our reasonable control may cause downtime.
9.2 Service-level commitments
Specific uptime commitments are governed by the Service Agreement between Wonderkind and your school, not these Terms.
10. Disclaimers
10.1 As-is service
Wonderkind is provided "as is" and "as available". To the maximum extent permitted by South African law, we make no warranties or representations:
- That the service will be uninterrupted, error-free, or secure
- That defects will be corrected
- That Wonderkind will meet your specific needs
- That records within the platform are infallible — your school's official records take precedence
10.2 Educational outcomes
We make no guarantees about educational outcomes for any child. Wonderkind is a tool to support school operations, not a determinant of educational quality.
10.3 Third-party services
Wonderkind integrates with third-party services. We are not responsible for the availability, accuracy, or behaviour of these third-party services, except as set out in our Privacy Policy.
11. Limitation of Liability
11.1 Excluded damages
To the maximum extent permitted by South African law, we will not be liable to you for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, opportunities, or anticipated savings
- Loss of data (except where caused by our wilful misconduct or gross negligence)
- Personal disputes between you and other users of the platform
11.2 Liability cap
For any cause whatsoever, our total aggregate liability to you personally is limited to R5,000.
This is appropriate because you do not pay Wonderkind directly for individual access — the commercial relationship is between Wonderkind and your school. Higher liability commitments are addressed in the school's Service Agreement.
11.3 Exceptions
The above limitations do not apply to:
- Liability for wilful misconduct or gross negligence
- Liability that cannot be excluded under South African law
12. Indemnity
You agree to indemnify and hold White Wolf Studio ZA (Pty) Ltd harmless against any claims, damages, losses, or costs (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your misuse of Wonderkind
- Content you upload that infringes the rights of any third party (especially children, families, or other users)
- Your violation of any law in connection with your use of Wonderkind
13. Termination
13.1 By you
You may stop using Wonderkind at any time by requesting your school administrator to deactivate your account, or by following the deletion process in your account settings.
13.2 By us or your school
Your school can deactivate your account at any time. We may suspend or terminate your access immediately if:
- You materially breach these Terms
- Your school instructs us to remove your access
- We are required to do so by law
- Your conduct poses a risk to children, other users, or the platform
13.3 Effect of termination
Upon termination:
- Your access to Wonderkind ends
- Your personal data may be exported or deleted in accordance with our Privacy Policy and the school's instructions
- Sections of these Terms that by their nature should survive (intellectual property, liability, indemnity, dispute resolution) continue to apply
14. Children's Use of the Platform
Wonderkind is not designed for direct use by children under 18. Where children's information is processed, it is processed by adults (staff and parents) on the children's behalf.
Older students may, with parental consent and school authorisation, have limited access to the platform (e.g., to view their own learning journey). In such cases, a competent person (parent or guardian) accepts these Terms on the child's behalf.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will notify schools and users by email and/or in-app notification at least 30 days before changes take effect (where practical)
- The "Last updated" date at the top will be revised
- Continued use of Wonderkind after changes take effect constitutes acceptance of the updated Terms
16. Governing Law and Disputes
16.1 Governing law
These Terms are governed by the laws of the Republic of South Africa.
16.2 Dispute resolution
For disputes between you and Wonderkind:
- First, contact us at hello@wonderkind.co.za to attempt resolution
- If unresolved within 30 days, the dispute may be referred to mediation
- Failing that, to the South African courts with jurisdiction over Johannesburg
For disputes between users (e.g., between a parent and a teacher), please address them through your school's procedures first. Wonderkind is not a forum for resolving interpersonal disputes.
17. General
17.1 Entire agreement
These Terms (together with the Privacy Policy and your school's Service Agreement, where applicable) constitute the entire agreement governing your use of Wonderkind.
17.2 Severability
If any provision of these Terms is found unenforceable, the remainder remains in force.
17.3 No waiver
Our failure to enforce any right under these Terms does not waive that right in future.
17.4 Assignment
You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our business.
17.5 Notices
We may send notices to the email address associated with your account or to your school. You can contact us at hello@wonderkind.co.za.
17.6 Force majeure
We are not liable for failure or delay in performance due to circumstances beyond reasonable control, including natural disasters, power outages, internet infrastructure failures, government action, war, or pandemic-related disruption.
